Children in Divorce & Child Custody

The first question anyone asks when they begin the divorce process is "What will happen to my children?", the welfare of the children involved is paramount. When you are thinking about divorce and the possible legal implications involved for children, Family Law Sheffield can help you answer your first question and others such as:

Will child maintenance payments be required?

Can I afford them?

Who gets custody of the children?

How is custody arranged?

Am I entitled to custody as a father?

Can I prevent my husband/wife from seeing my children?

Can my wife stop me from seeing my children?

Child custody isn't raised automatically on petition for divorce. For every child under the age of 16, or over the age of 16 but under the age of 18 and in full time education or training for a professional trade or vocation, you need to complete a document called a 'statement of arrangements for children'

The 'statement of arrangements for children' form has four detailed sections each requiring in depth information about the child's home life and schooling and responsibilities for their care and maintenance. This is a lot of detail and getting expert professional advice when filling it in will pay dividends at the start of any court proceedings.

It should also be considered that since April 2011, if you're a divorcing couple, prior to going to court and debating finances on divorce a Mediation Assessment is required.
